Terms of Service

This document is a placeholder while CapitalSource.ai prepares its V2 launch. The final Terms of Service will be reviewed by counsel before going into effect. Until then, the terms below summarize our intent; they do not constitute a binding agreement.

1. Acceptance

By creating an account, you agree to be bound by these Terms and our Privacy Policy. You represent that you have authority to bind the organization you sign up for.

2. Service description

CapitalSource.ai is a software platform that helps brokers prepare CSG-1003-conformant commercial credit applications and (in Phase 5) helps funders subscribe to certified deal packages. We are not a lender, broker, ISO, or financial advisor.

3. Originations and Reviews

Origination charges are incurred when the Processor agent dispatches a certified CSG-1003 package on your behalf. Review charges (Phase 5) are incurred when a funder views a non-owned, broker-submitted deal package. All usage events are recorded in the usage_events ledger and reconciled against Stripe.

4. Acceptable use

You may not use the service to submit fraudulent applications, harass funders, or attempt to access another tenant’s data. We may suspend or terminate accounts that violate this clause.

5. Data ownership

You retain all rights in the applicant data you input. We process it solely to deliver the service. Certified packages signed under your organization remain yours; we do not re-sell or re-distribute them outside the explicit broker-funder routing you configure.

6. Warranties

The service is provided "as is" without express or implied warranties beyond those required by applicable law. We do not warrant that any funder will fund any submitted deal.

7. Limitation of liability

To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months preceding the claim.

8. Changes

We may update these Terms before V2 launch. Material changes will be announced via the billing contact on file and via this page.
